Kogan FIRST Rewards Credits Terms and Conditions

Definitions

Kogan.com Account means an active Kogan customer account that is linked to the Earn Locations.

Kogan FIRST means the Kogan FIRST customer membership program.

Kogan FIRST Member means a current and active member of Kogan FIRST.

Kogan FIRST Membership means a membership for Kogan FIRST.

FIRST means the Dicksmith.com.au, Mattblatt.com.au & Brosa.com.au FIRST customer membership program

FIRST Member means a current and active member of FIRST.

Kogan FIRST T&Cs means the terms and conditions that govern your Kogan FIRST Membership.

Kogan Group means Kogan Australia Pty Ltd and its related bodies corporate.

Rewards Credits or Kogan First Rewards Credits has the meaning given to ‘Reward Credits’ in the ‘What are Rewards Credits?’ section of these terms and conditions.

Earn Locations are: for Kogan FIRST Members, www.kogan.com/au/ and the Kogan.com Australia App, for FIRST Members, www.dicksmith.com.au, www.mattblatt.com.auwww.brosa.com.au/ and any other online store or location we nominate from time to time.

Eligible Products means any product sold at the Earn Locations that is not an Ineligible Product.

Ineligible Products means any product that is deemed by us (in our discretion from time to time) to be a product for which you may not earn Rewards Credits.

Minimum Rewards Credits Level has the meaning set out in section 9.

  1. What are Rewards Credits?

    Rewards Credits are what you collect when you purchase Eligible Products at the Earn Locations.

  2. How do I earn Rewards Credits?

    You can earn Rewards Credits by purchasing Eligible Products at the Earn Locations. You must be logged into your Kogan.com Account and have an active Kogan FIRST Membership or Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account, and have an active FIRST membership when you purchase an Eligible Product in order to earn Rewards Credits for that purchase.

  3. Can I use Rewards Credits earned on Kogan.com for purchases on Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au (and vice versa)?

    No. All Kogan FIRST Rewards Credits earned on Kogan.com can be spent on Kogan.com only. All FIRST Rewards Credits earned on Dick Smith, Matt Blatt and Brosa can be spent on their respective stores only.

  4. At what rate will I earn Rewards Credits?

    When you purchase Eligible Products at an Earn Location, you will earn the percentage of your order total (in AUD) in Rewards Credits published here (Earn Percentage) to use at the Earn Locations. For example, if the current Earn Percentage is 1%, and you spend $100 on a product on Kogan.com (made up of $88.89 product price plus $11.11 GST), you will earn $1.00 Rewards Credits . We reserve the right to increase or reduce  the Earn Percentage from time to time.

  5. When will Rewards Credits be credited to my account?

    In many cases, Rewards Credits will be credited to your Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account on or around the date when your order is shipped. The latest time that Rewards Credits will be credited to your account is 30 days after shipment of a purchase on which you have earned Rewards Credits.

  6. On which purchases will I not earn Rewards Credits?

    You will not earn Rewards Credits on purchases of Ineligible Products including the purchase of gift cards.

  7. How and when can I enjoy my Rewards Credits?

    Subject to any Minimum Rewards Credits Level requirements (see section 9), you can spend your Rewards Credits on purchases at Kogan.com for Reward Credits earned on Kogan.com and at Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au. For example, if you are purchasing a $20 product and you have earned and saved up 10 Rewards Credits in your Kogan.com Account, you can pay $10 of the product with Rewards Credits, and the other $10 of the product, plus any GST and shipping charges, with your preferred payment method, such as your credit card. If there is a Minimum Rewards Credit Level in place (see section 9 below), you may be restricted to only using your Rewards Credits in exact multiples of the Minimum Rewards Credit Level. For example, if the Minimum Rewards Credit Level is $10 and you have $34 in accrued Rewards Credit, you may only be able to use multiples of $10 ($10, $20, $30) on purchases, and the remaining amount will be in your account (until its expiry – see section 12).

  8. What do I need to do to enjoy money off my purchases?

    You can spend your Kogan FIRST Rewards Credits on purchases made at Kogan.com or on the Kogan.com App for iOS or Android. You can spend your FIRST Rewards Credits on purchases made at Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au. To pay with Rewards Credits on Kogan.com, ensure you are logged into your Kogan.com Account with an active Kogan FIRST Membership and select the “Credits” payment option during checkout. To pay with Rewards Credits on Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au ensure you are logged into your Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account with an active FIRST Membership and select the “Credits” payment option during checkout. We may require you to go into your account and activate (or convert) your Rewards Credits into “Credits” before they can be used on purchases.

  9. When can I enjoy spending my Rewards Credits on purchases?

    You can choose to spend your Rewards Credits on purchases as soon as you have Rewards Credits available to spend in your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account (subject to any activation required under section 8).
    We may require a certain value of Rewards Credits to accumulate before you can spend them (Minimum Rewards Credit Level), and we may change this value from time to time. For example, if we set the Minimum Rewards Credits Level at $10, and the value of the Rewards Credits in your Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account is less than $10, you will only be able to spend your Rewards Credits once they increase to $10. The Minimum Rewards Credit Level will be published here

  10. On which purchases can I not apply Rewards Credits?

    Rewards Credits cannot be applied to purchases:

    1. That are not made on Kogan.com/au/ or the Kogan.com Apps (or for FIRST Members, on Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au);

    2. Made when you are not a current and active Kogan FIRST Member;

    3. Made when you are not signed into your Kogan FIRST Account; or

    4. on Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au if you are Kogan FIRST member for purchases, or to purchases on Kogan.com if you are a FIRST Member.

  11. Is there a maximum number of Rewards Credits that I can have in my account?

    No. However, we reserve the right to apply a maximum limit on the amount of Kogan FIRST Rewards Credits that you may earn by updating these terms and conditions in accordance with clause 10 of the Kogan T&Cs.

  12. Will my Rewards Credits expire?

    Your Rewards Credits will expire if you cease to be a Kogan FIRST member, but otherwise Rewards Credits have a 1 year expiry.

  13. Where can I check my Rewards Credits balance?

    You can check your Rewards Credits balance by logging into your Kogan.com Account and navigating to the Credits menu.

  14. Can someone else use my Rewards Credits?

    No, Rewards Credits are personal to you and cannot be transferred to or used by anyone else.

  15. Can these terms and conditions be changed or terminated?

    Yes, we may amend or terminate these terms and conditions in accordance with clause 10 of the Kogan FIRST T&Cs.

  16. What are my responsibilities in relation to my Kogan FIRST Rewards Credits?

    Please keep your personal details updated by updating your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account. This is because, if you don’t keep your personal details up to date, we may not be able to provide you with your Rewards Credits, and we may need to cancel your Kogan FIRST Membership.

    It is your responsibility to keep your Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account username and password safe and secure. Please treat your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account password as your confidential information. You must take all reasonable steps to prevent unauthorised use or access to your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account and information about your membership, including your account password. This includes that you must not use a password for your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account which you have used for any other of your other online accounts. You acknowledge that unauthorised access to your Kogan.com, Dicksmith.com.au, Mattblatt.com.au and Brosa.com.au Account and personal information may occur if you do not take these steps.

  17. What are Kogan’s other rights in relation to the Kogan FIRST Rewards Credits program?

    We may add or remove items from the list of items or types of items which are deemed to be Ineligible Products without notice to you.

    We may reverse any Rewards Credits which have been allocated to your Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account where you have returned the Eligible Products or you have been refunded for the Eligible Products in respect of which those Rewards Credits were earned.

    We may reverse any Rewards Credits which have been allocated to your Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au Account if there are any other grounds which we consider (in our discretion) justify a reversal - for instance, if the Rewards Credits were allocated to your Kogan.com Account by mistake (including through our error) or if you earned them by misusing an offer, or through fraudulent means.

    We reserve the right to monitor your purchase history to ensure that any Rewards Credits are accumulated legitimately.

    We reserve the right at any time without notice to reverse any Rewards Credits allocated to your Kogan.com, Account where we have grounds to do so under these terms and conditions.

    Grounds for reversing any Rewards Credits allocated to your Kogan.com, 

    1. abuse, misuse or attempt to abuse or misuse your Rewards Credits, or anything else associated with Kogan.com, Dicksmith.com.au, Mattblatt.com.au or Brosa.com.au;

    2. do anything that is contrary to these terms and conditions;

    3. fraudulently accumulate Rewards Credits.

    4. use or attempt to use your Rewards Credits for purchases made by a person other than you;

    5. engage in unacceptable conduct in connection with your Rewards Credits, which will be deemed to include if Kogan.com has a reasonable suspicion of conduct by you which amounts to dishonesty, fraud or wrongful conduct;

    6. become bankrupt or die; or

    7. do not have an active and paid up Kogan FIRST Membership or FIRST membership (as applicable).

    You agree that, except to the extent that these terms and conditions expressly provide otherwise, we do not need to notify you in advance, or give you any reasons, with regard to any action we take concerning your Rewards Credits.

  18. What is Kogan’s liability in respect of the Kogan FIRST Rewards Credits program?

    You acknowledge and agree that there may be:

    1. delay in issuing you with, or non-issue to you of, any Rewards Credits; acts, errors or omissions by us in the course of administering your Rewards Credits; a suspension and/or termination of the Kogan FIRST Rewards Credits program, including the ability for members to collect Rewards Credits, and to the maximum extent permitted by law (and provided that nothing in these terms and conditions limits your rights under the Australian Consumer Law), we will not be liable to you in any way for any cause in connection with such matters, including for any unused Rewards Credits in your account at the time of termination or their expiry.

    You agree that any comments, suggestions or recommendations you may receive from us or others in relation to Rewards Credits may not be suitable, accurate or complete and you must not rely on them in a way which may give rise to any loss or damage.
